First-degree murder charges have been dropped against a 46-year-old Rochester man in connection with a fatal shooting along North Dirksen Parkway in Springfield in April.

Sangamon County State’s Attorney John Milhiser told Newschannel 20 that his office and Springfield Police determined that Nicholas Kammueller acted in self-defense when he shot and killed 51-year-old Gerald Fahey of Springfield.

Milhiser said Fahey’s girlfriend had been in a traffic accident involving Kammueller, and Fahey was shot when he entered Kammueller’s vehicle and threatened to kill him.

Kammueller has a valid concealed carry license but it prohibits carrying a weapon when intoxicated, and he faces a misdemeanor charge for that as well as driving under the influence. His next court hearing is scheduled for August.
