A federal Judge has granted a request to temporarily block a National Guard deployment in Chicago, saying the move violates the U.S. Constitution.
Judge April Perry ruled that Trump’s Deployment of Troops to Chicago violated the 10th and 14th amendments as well as the 150-year-old Posse Comitatus Act that limits the military’s role in enforcing domestic laws.
U.S. District Judge April Perry also noted the ongoing protests outside a local immigration processing center have never exceeded 200 demonstrators. She said the demonstrations fall far short of the high legal bar needed to be characterized as a “rebellion” that would allow the administration to take control of the Illinois National Guard and deploy troops from Texas and California to Chicago.
While Perry acknowledged protesters have assaulted immigration agents and damaged federal property, the judge said there was far more evidence that the feds actually escalated or even caused clashes with activists.
Judge Perry stated that she plans to issue another ruling on Friday in the case.
